Marshall County Birth Record Eligibility

Oklahoma limits who can get a certified birth certificate. Under Title 63, Section 1-323, only certain people qualify. The law changed in November 2016.

Eligible requesters include the person on the record (if of legal age), a parent on the certificate, a legal guardian with court papers, an attorney with signed authorization, and anyone with notarized written permission from the subject. Extended family members like spouses, stepparents, grandparents, and adult children need proof of their relationship plus signed authorization. Every request must include a clear copy of a valid government-issued photo ID. Accepted forms are a driver's license, U.S. passport, military ID, or tribal ID with signature. Never send your original ID.

Records 125 years or older are open. You still pay the fee and show ID, but you skip the eligibility proof.

Birth Certificate Filing Rules

Oklahoma law under Title 63, Section 1-311 says the doctor, midwife, or other person at the birth must file a birth certificate with the state within five days. The record must list the child's name, date and place of birth, parents' names with the mother's maiden name, and sex as male or female.

Errors on a Marshall County birth certificate can be fixed through the state amendment process. You submit supporting documents, and the state makes the correction. The amendment fee is $40, which includes one certified copy. Amendments, delayed registrations, and paternity or adoption cases can take up to four months to process due to backlogs at the OSDH office.
